What Luxembourg financial institutions must report

Luxembourg and the United States signed a Model 1 intergovernmental agreement on 28 March 2014, implemented by the Luxembourg law of 24 July 2015. Luxembourg reporting financial institutions report their US reportable accounts — and the payments made on them — to the ACD in XML by 30 June of the following year; the ACD forwards the information to the US Internal Revenue Service.

GIIN and filer category

Each reporting FI, sponsor and intermediary is identified by its GIIN and its FATCA filer category.

US persons and owners

US TINs for individuals, and the substantial US owners of passive entities.

Balances and payments

Year-end balances plus dividends, interest, gross proceeds and other payments.

Amendments and voids

Records already accepted are amended or voided by reference, never simply sent again.

From your data to the ACD’s answer, in five steps

  1. Import

Excel files from custodians and transfer agents, or FATCA XML files already filed with the ACD.

  2. Check

GIINs, US TINs, owners and payments are checked as you type.

  3. Export

The FATCA XML is validated against the ACD schemas before you can download it.

  4. File

Fund XP transmits your files to the ACD as depositor.

  5. Close the loop

The ACD’s status message comes back and is applied to your project.

FATCA details checked before the file leaves

One panel lists the problems of the whole report; one click opens the account on the right field.

GIIN format

Typed with its capitals and its dots placed automatically, in the shape XXXXXX.XXXXX.XX.XXX.

US persons

US TINs, US residence and the substantial US owners of passive entities, checked field by field.

Sponsored entities

Sponsors and intermediaries carry their own GIIN and filer category.

Payments

By type — dividends, interest, gross proceeds and other — in the account currency.

Why a FATCA filing is rejected

In most cases the account data is sound and the file structure is not.

CauseWhat happens
MessageRefId reusedEach message carries an identifier unique to the sender. Reusing one from a previous filing has the whole file rejected, however sound the data.
DocRefId not uniqueEvery record carries its own identifier, unique over time and never reused. An export regenerated without renewing them fails.
Amendment without CorrDocRefIdAn amendment has to name the record it replaces. Without that reference it is treated as a new account, and the holder ends up reported twice.
GIIN with the letter OA GIIN never contains the letter O. What looks like one is the digit zero, and the check fails on it.
GIIN not issued or lapsedA well-formed GIIN that the IRS FFI List does not carry, or carries no longer.
Missing US TINA US reportable account with no TIN, where the agreement expects one or an explicit code in its place.
No nil reportA reporting FI with nothing to report still files. Silence is not a return.

You change the data — the platform writes the FATCA record

The platform keeps the history of every record sent and accepted, and sends what the ACD expects for each change.

File with the ACD and follow up in the same place

  • Each file is checked once more before it leaves: name, depositor, ACD schema.
  • Fund XP transmits it to the ACD as depositor. Optional.
  • The ACD’s status messages come back and are matched to the files sent.
  • Accepted or rejected, applied in one click, with the ACD errors shown on the accounts and an e-mail notification.

Your account data stays yours

Encrypted project file

Account data is kept in an encrypted file on your computer. The server only handles sign-in, keys and the files you choose to send.

Two-factor sign-in and rights

Each user prepares, reviews or administers, with read-only access for reviewers.

Sealed audit trail

Every change is logged, and the trail of each project is sealed on the server.

FATCA reporting in Luxembourg — frequent questions

What is the deadline for FATCA reporting in Luxembourg?

FATCA reports are filed with the ACD by 30 June of the year following the reporting year — for example by 30 June 2027 for the 2026 reporting year.

Who has to file a FATCA report with the ACD?

Luxembourg reporting financial institutions under the law of 24 July 2015 implementing the Luxembourg–US intergovernmental agreement, including investment funds, unless they qualify as non-reporting or deemed-compliant institutions.

Does the ACD send the FATCA reports to the IRS?

Yes. Under the Model 1 agreement, Luxembourg institutions report to the ACD, which exchanges the information with the IRS.

How do I correct a FATCA record already accepted?

Edit the account in the platform. It sends an amended record (FATCA4) or a void record (FATCA3) referencing the accepted one, in its own file.

Can sponsored entities be reported?

Yes. A reporting FI can have a sponsor and an intermediary, each with its GIIN and filer category, reported in the FATCA file.

Does the platform also handle CRS?

Yes. CRS and FATCA reports are prepared in the same project. See CRS reporting in Luxembourg.
